Definitions

• “Service” means the Online-Exams.org website, platform, applications, tools, features, and related services.
• “User” means any person who accesses or uses the Service.
• “Customer” means a school, university, educator, training provider, company, institution, or other organization that uses or purchases the Service.
• “Authorized User” means a person permitted by a Customer to use the Service, including educators, administrators, examination staff, and students.
• “User Content” means information or materials submitted to or created through the Service, including examination questions, answer keys, student answers, code submissions, grades, reports, feedback, logos, branding, messages, and other content.

The Service

Online-Exams.org provides tools that allow educators and organizations to:

• create and configure examinations;
• publish examinations and control access;
• invite students to take examinations;
• support examination sessions across compatible devices;
• automatically grade certain answers or submissions;
• review grades, statistics, and performance information; and
• use examination security and integrity controls.

The features available to you may depend on your account type, subscription, organization, device, browser, and the settings selected by the Customer or educator administering an examination.

Online-Exams.org does not provide educational instruction, determine academic policies, or award academic qualifications. The Customer or educator remains responsible for examination content, grading policies, academic decisions, student communications, and compliance with applicable education laws and regulations.

Eligibility and authority

You may use Online-Exams.org only if you are legally capable of entering into a binding agreement, or if your use is authorized and supervised by a parent, guardian, school, educator, or other organization that is legally responsible for your access.

Students may use the Service when invited or directed by a school, university, educator, training provider, or other organization.

If you use the Service on behalf of an organization, you confirm that:

• you are authorized to represent that organization;
• the organization agrees to these Terms; and
• you have authority to bind the organization to these Terms.

If you are under the age of legal majority, you may use the Service only with the permission or authorization required by applicable law.

Accounts and account security

Some features require you to create an account.

You agree to provide information that is accurate, complete, and current. You must update your information when necessary to keep it accurate.

Your account is personal to you. You may not transfer, sell, lend, or share your account with another person.

You are responsible for:

• keeping your username, password, and authentication information confidential;
• all activity conducted through your account;
• using reasonable security measures to protect your account; and
• notifying Online-Exams.org through the Contact Us form if you believe your account has been accessed without authorization.

We may suspend or restrict an account where we reasonably believe that it has been compromised, misused, or used in violation of these Terms.

Customer and educator responsibilities

Customers and educators are responsible for:

• ensuring that examination content is accurate, lawful, and appropriate;
• ensuring that they have the rights and permissions necessary to upload examination content;
• selecting appropriate examination settings;
• communicating examination rules and integrity requirements to students;
• using student information only for authorized educational or organizational purposes;
• providing any notices, permissions, or consents required by applicable law;
• configuring access so that only authorized people can view examination content or results;
• reviewing automatic grades and integrity signals before making important academic decisions; and
• complying with applicable privacy, education, accessibility, consumer-protection, and records-retention laws.

Customers are responsible for the acts and omissions of their Authorized Users and for maintaining the confidentiality of examination content, student information, account credentials, and access links.

Examination integrity

Online-Exams.org may provide controls intended to support fair and secure examination conditions. These controls may restrict access to certain browser features, external resources, unauthorized tools, or other functions during an examination.

Depending on the settings selected by the educator or organization, the Service may record examination-session events such as login activity, access attempts, full-screen changes, focus changes, navigation events, copy or paste events, technical interruptions, or other security signals.

Students must follow the examination rules communicated by the educator or organization administering the examination.

You may not:

• access unauthorized resources or tools during an examination;
• use unauthorized assistance, including artificial intelligence tools, answer-sharing services, or another person’s help;
• impersonate another student;
• allow another person to take an examination on your behalf;
• share examination questions, answers, access codes, or other restricted content without authorization;
• attempt to bypass, disable, test, or interfere with examination security controls; or
• use Online-Exams.org to facilitate cheating, academic misconduct, or unauthorized collaboration.

Online-Exams.org does not guarantee that every attempt to use unauthorized assistance will be prevented or detected. Academic or disciplinary decisions remain the responsibility of the educator, school, university, or other organization administering the examination.

Acceptable use

You may use Online-Exams.org only for lawful and authorized purposes.

You must not:

• violate any applicable law or regulation;
• infringe another person’s intellectual property, privacy, confidentiality, or other rights;
• upload or transmit malware, viruses, worms, spyware, ransomware, or other harmful code;
• interfere with, disrupt, damage, or overburden the Service;
• attempt to gain unauthorized access to any account, examination, system, network, or data;
• probe, scan, or test the vulnerability of the Service without written authorization;
• use automated tools to scrape, crawl, copy, monitor, or collect data from the Service;
• bypass access controls, usage limits, security measures, or examination restrictions;
• reverse engineer, decompile, disassemble, or attempt to discover the source code of the Service, except where applicable law expressly permits it;
• copy, modify, reproduce, distribute, sell, lease, sublicense, or create derivative works from the Service;
• use the Service to develop a competing product or service;
• impersonate another person or organization;
• misrepresent your identity, role, affiliation, or authority;
• send spam, phishing messages, chain letters, or unauthorized promotional communications;
• harass, threaten, abuse, stalk, intimidate, or discriminate against another person;
• upload content that is unlawful, defamatory, obscene, hateful, violent, exploitative, or otherwise harmful;
• upload content involving child sexual exploitation or abuse;
• use the Service to harm or exploit minors;
• collect personal information about other users without authorization; or
• encourage or assist another person to violate these Terms.

User Content

You retain ownership of User Content that you lawfully submit to Online-Exams.org.

You are responsible for User Content and confirm that:

• you own it or have all rights and permissions needed to use it;
• its submission and use do not violate any law or agreement;
• it does not infringe the rights of another person or organization;
• it does not contain unnecessary sensitive personal information; and
• it complies with these Terms and the Privacy Policy.

You grant Online-Exams.org a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, display, modify as technically necessary, and otherwise process User Content only as reasonably necessary to provide, secure, maintain, and improve the Service.

This license ends when the User Content is deleted, except that copies may remain for a limited period in backups or where retention is required by law or by the Customer’s instructions.

We may remove, restrict, or refuse to publish User Content if we reasonably believe it violates these Terms, infringes another person’s rights, creates legal or security risk, or threatens the safety of users or the Service.

We are not responsible for the accuracy, completeness, legality, or usefulness of User Content submitted by users or Customers.

Online-Exams.org intellectual property

The Service and all materials provided by Online-Exams.org, including software, designs, interfaces, text, graphics, logos, trademarks, documentation, databases, methods, and technology, are owned by or licensed to the Online Exam organization.

These Terms do not transfer ownership of the Service or any Online-Exams.org materials to you.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for its intended purpose.

You may not remove copyright, trademark, or proprietary notices from the Service or use Online-Exams.org branding without permission.

Feedback

If you provide suggestions, ideas, comments, or other feedback about Online-Exams.org, you allow us to use that feedback without restriction or payment to you.

We may use feedback to improve, develop, or modify the Service, provided that we do not publicly identify you without permission.

Privacy

Our Privacy Policy explains how we collect, use, share, retain, and protect personal information.

By using Online-Exams.org, you acknowledge that personal information will be processed as described in the Privacy Policy.

Where a Customer provides student information to Online-Exams.org, the Customer may control how that information is used and may provide additional privacy notices or instructions.

Paid subscriptions and payments

Some Online-Exams.org features may require payment.

Prices, subscription periods, renewal terms, taxes, and other commercial terms will be shown before you complete a purchase or subscription.

If you choose a recurring subscription, you authorize the applicable subscription fees to be charged at the beginning of each billing period until the subscription is cancelled.

Payments are processed by Stripe. Stripe may collect and process payment information in accordance with its own terms and privacy practices.

You are responsible for providing accurate billing information and paying all charges associated with your account.

You may cancel a subscription through the available account controls or by using the Contact Us form. Cancellation will normally take effect at the end of the current paid period unless the applicable purchase terms or law provide otherwise.

Refunds, credits, and cancellations are handled according to the applicable purchase terms and mandatory consumer-protection laws.

We may suspend access to paid features if payment is overdue, reversed, declined, or disputed without a reasonable basis.

Third-party services

Online-Exams.org may use or connect to third-party services, including hosting, authentication, analytics, communications, payment, and security providers.

Third-party services may have their own terms and privacy policies. We are not responsible for third-party services that we do not control.

If you choose to access or use a third-party service through Online-Exams.org, you do so at your own risk and are responsible for complying with that third party’s terms.

Service availability and technical requirements

You are responsible for obtaining the device, browser, internet connection, and other technical resources needed to use Online-Exams.org.

The Service may be unavailable or interrupted because of maintenance, updates, security incidents, network failures, device limitations, third-party services, or circumstances outside our reasonable control.

We may modify, suspend, replace, or discontinue any part of the Service. We will provide notice of material changes where required by law or applicable agreement.

Online-Exams.org does not guarantee that the Service will always be available, uninterrupted, secure, error-free, or compatible with every device or browser.

Suspension and termination

You may stop using the Service at any time.

We may suspend or terminate your access if:

• you violate these Terms;
• your account is used in a way that creates security, legal, or operational risk;
• your payment obligations are not met;
• we are required to do so by law or a governmental authority;
• your access is provided through a Customer whose account or subscription has ended; or
• suspension is necessary to protect the Service, users, or another person.

Where reasonably practicable, we will provide notice before suspension or termination. We may act without prior notice when urgent action is necessary.

When access ends, you must stop using the Service and must not attempt to create a replacement account to avoid a suspension or termination.

Termination does not affect rights or obligations that by their nature should continue, including provisions concerning intellectual property, User Content, payment obligations, disclaimers, liability, indemnification, dispute resolution, and general terms.

Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, ONLINE-EXAMS.ORG PROVIDES THE SERVICE “AS IS” AND “AS AVAILABLE.”

WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR AVAILABLE AT ALL TIMES.

WE DO NOT GUARANTEE THE ACCURACY OR COMPLETENESS OF EXAMINATION CONTENT, AUTOMATIC GRADES, STATISTICS, REPORTS, INTEGRITY SIGNALS, OR OTHER INFORMATION PROVIDED THROUGH THE SERVICE.

ONLINE-EXAMS.ORG IS NOT RESPONSIBLE FOR ACADEMIC RESULTS, EXAMINATION OUTCOMES, DISCIPLINARY DECISIONS, OR ACTIONS TAKEN BY A SCHOOL, UNIVERSITY, EDUCATOR, TRAINING PROVIDER, OR OTHER ORGANIZATION.

WE DO NOT GUARANTEE THAT EXAMINATION SECURITY CONTROLS WILL PREVENT ALL UNAUTHORIZED ACCESS, CHEATING, ACADEMIC MISCONDUCT, OR USE OF ARTIFICIAL INTELLIGENCE TOOLS.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY WARRANTY, RIGHT, OR REMEDY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ONLINE-EXAMS.ORG AND ITS SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, DATA, GOODWILL, OR EXPECTED SAVINGS.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

• THE TOTAL AMOUNT YOU PAID TO USE THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
• 100 UNITED STATES DOLLARS.

These limitations do not apply to liability that cannot be excluded or limited under applicable law, including liability for fraud, intentional misconduct, or other liability that the law requires to remain available.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless the Online Exam organization and its officers, employees, contractors, licensors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising out of or related to:

• your violation of these Terms;
• your User Content;
• your misuse of the Service;
• your violation of another person’s rights; or
• your violation of applicable law.

This obligation does not apply to the extent that a claim results from our own unlawful conduct or a matter that cannot lawfully be subject to indemnification.

Governing law and disputes

These Terms are governed by the laws applicable in the jurisdiction where the Online Exam organization is established, without regard to conflict-of-law rules.

Any dispute arising out of or relating to these Terms or the Service may be brought before a court with jurisdiction over the Online Exam organization, unless mandatory law gives you the right to bring a claim elsewhere.

If you use Online-Exams.org through a school, university, or other organization, a written agreement between that organization and the Online Exam organization may contain additional dispute-resolution terms. If there is a conflict concerning Customer data or organization-specific services, the written customer agreement will control.

Changes to these Terms

We may update these Terms from time to time.

The updated version will be posted on Online-Exams.org with a revised “Last updated” date. If we make a material change, we may also provide notice through the Service, through the Contact Us system, or by another legally appropriate method.

Your continued use of Online-Exams.org after updated Terms become effective means that you accept the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

General terms

If any provision of these Terms is found to be invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will remain in effect.

Our failure to enforce a provision of these Terms is not a waiver of our right to enforce it later.

You may not transfer your rights or obligations under these Terms without our written permission. We may transfer these Terms as part of a merger, acquisition, reorganization, sale of assets, or transfer of the Service.

These Terms, together with the Privacy Policy and any applicable written customer or subscription agreement, constitute the entire agreement concerning your use of Online-Exams.org.
